Release of Liability

This Release of Liability Agreement (hereinafter referred to as 'Agreement') is made and entered into by and between the service provider (hereinafter referred to as 'service provider' or ‘independent contractor’) and the signed below client (‘hereinafter referred to as 'Client'). This Agreement pertains to the care, release, and transportation services provided for children, pets, adults, elderly individuals (hereinafter collectively referred to as 'Dependents') and/or any other service provider type provided by Nanny’s & Granny’s. This release includes, but is not limited to, transportation or outings to any and all locations, such as but not limited to appointments, events, activities, school, pool, arcade, casino, etc. and the general care and release to another party and supervision of the Dependents.

The Client hereby releases and holds harmless the Service provider and Nanny’s & Granny’s from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or any type of injury, that may be sustained by the Dependents or any property belonging to the Client while participating in any transportation or care activities under this Agreement, or while in, on or upon the premises where the services are being provided, except to the extent such loss or damage is due to the gross negligence or willful misconduct of the Service provider.

This agreement will apply to all Nanny’s & Granny’s Independent Contractors and will remain in effect for any Independent Contractor that I use because of my relationship with Nanny’s & Granny’s. I understand that all individuals used through Nanny's & Granny's service are Independent Contractors. I understand and agree that Nanny’s & Granny’s does not accept liability for any of my private arrangements and moreover that Nanny's & Granny's has no insurance to protect my private arrangements for the transportation of my child(ren) by the independent contractor. Additionally, I understand that this is a private arrangement made between me and the Independent Contractor and I agree to hold Nanny's & Granny's harmless in any lawsuit that should occur involving the transportation of my child(ren), adults, elderly, and pets by a Nanny's & Granny's Independent Contractor service provider. I also agree to install any car seats needed into the service provider’s car myself. Service provider agrees to use all necessary safety measures during transportation of Dependents, including the use of car seats for children, secure carriers for pets, and any necessary assistive devices for adults and elderly individuals. Client agrees to preapprove any individuals other than the service provider who may be involved in the transportation or care of the Dependents (such as the use of Uber, Lyft or licensed Taxi services).

The client is responsible for providing the service provider with reimbursement for mileage at the rate of at least $1.00 per mile or at current rate. I agree that if I am a visitor to Las Vegas and/or am staying in a resort, hotel, Airbnb, or equivalent, that I will provide the sitter with funds for a taxi, Lyft, or Uber for the transportation of the children. I will provide funds and reimbursements for any activities, food, snacks, or necessities for any and all outings. All financial reimbursements shall be made upon completion of the service with the receipt of the service provider's written statement of expenses.

Client shall provide the Service provider with emergency contact information, medical information for Dependents, and any other information deemed necessary for the Service provider to provide safe and effective care. In the event of an emergency, the Service provider is authorized to seek medical treatment for the Dependents as required.

Client shall provide a list of individuals authorized to pick up or take custody of the Dependents in the Client's absence. This list must include full names, relationship to the Dependents, and contact information. The Service provider will only release the Dependents to individuals on this list, unless otherwise directed by the Client in writing. **If otherwise directed by the Client, writing should be submitted prior to service directly to the Nanny’s & Granny’s agency.

This Agreement shall be effective on the date of the last signature below and will remain in effect until terminated by either party with written notice.

By signing below, both parties acknowledge they have read, understood, and agree to the terms of this Agreement.
